Who is liable when a child is hurt right outside the front door?

Summer is just around the corner, and with that comes summer vacation for our kids. In a couple months, kids across Atlanta will be spending the days playing video games, going to friends' houses and running around outside.

As much as parents try to keep an eye on their kids and keep them safe, accidents do happen, and often right outside our door. With this in mind, we will explore some of the common accidents that happen in our own neighborhoods as well as who may be responsible.

  • Falls off playground equipment may stem from negligent design or maintenance of the equipment
  • Drownings in backyard swimming pools can be the result of a failure to secure the premises
  • A pedestrian or bicycling accident involving a child could be the fault of a reckless, unsafe driver
  • Falling injuries caused by sidewalks or roads in disrepair may be tied to failed maintenance from the city
  • Injuries from a deck or patio collapse could be linked to a negligent property owner
  • Cuts, burns or amputations caused by malfunctioning lawn mowers and other equipment may be the fault of a defective product designer or manufacturer

It should be noted that accidents involving kids happen regardless of negligence or carelessness. In other words, there may be no one to hold legally accountable for a child's injuries.

However, if there is someone who failed to take the proper steps to keep a child and others safe near pools, at parks, in community spaces or on the sidewalks and roads around our homes, it can be important that that party be held responsible for the damages suffered as a result of his or her failed duty.

If you have questions regarding liability after your child's accident, it can be a good idea to talk to an attorney about your legal options. If there is someone to hold responsible, an attorney can help you file a claim to seek the compensation you need and deserve.
