Remember your DMV hearing post-arrest for DUI

After you are arrested for driving under the influence, you should attend to certain challenges as quickly as you can. First, it is generally important for you to seek the guidance of an attorney experienced in criminal defense matters. An attorney will be able to guide you through the legal system as successfully as possible. Without the advice of an attorney, you leave yourself vulnerable to potentially costly mistakes and challenges that you might otherwise be able to avoid.

In addition, it is important to request a hearing with your state’s Department of Motor Vehicles. Your attorney will likely be able to advise you in regards to your state’s specific laws related to DUI charges and driver’s license suspension. But most states do treat an individual’s criminal case separate from his or her administrative DMV hearing. Although you are compelled to deal with this administrative matter, you generally must be the one to request your DMV hearing.

Depending on the laws of your state, you may or may not have had your driver’s license automatically suspended as soon as you were arrested on DUI charges. Even if the charges against you are dropped or your attorney is able to negotiate a plea for a downgraded charge, your license will generally remain revoked or suspended until you attend your administrative hearing.

You may only have a week or so to file a request for your hearing, so it is very important that you act on this matter as quickly as possible. If you have any questions about either your administrative hearing or your criminal case specifically, please direct them to your attorney.
